Terms of Service

1. Definitions

  • "Anomaly Arts" (also "we", "us", "our") refers to Anomaly Arts, based at 60 Triq tas-Sliema, Gżira, Malta, operated by Valentin Lecompte.
  • "Client" (also "you", "your") refers to any individual or business that engages our services.
  • "Website" refers to the website(s) designed, developed, and maintained by Anomaly Arts on behalf of the Client.
  • "Service" refers to the web design, development, hosting, and maintenance services provided by Anomaly Arts.

2. Services

Anomaly Arts provides web design, web development, hosting, and website maintenance services for businesses in Malta. The specific scope of each project is agreed upon before work begins.

Marketing Website Package (€150/month)

This package includes:

  • Up to 5 professionally designed pages
  • .com.mt domain registration and renewal
  • Website hosting with SSL certificate
  • Mobile-responsive design
  • Weekly backups
  • Ongoing maintenance and updates (up to 1 hour per month included)
  • Email support

Maintenance work exceeding 1 hour per month will be quoted separately and agreed upon before being carried out.

Custom Development

Custom projects (e-commerce platforms, web applications, and other bespoke solutions) are quoted individually. Terms specific to custom projects will be outlined in a separate project proposal or agreement.

3. Contract Duration and Renewal

The Marketing Website Package is a 12-month contract, billed monthly at €150/month. At the end of the 12-month period, the contract is automatically renewed for another 12 months under the same terms, unless either party gives written notice of termination before the renewal date.

4. Payment Terms

  • Payment is due on the 1st of each month (or as specified in your invoice).
  • Payments are made via Revolut or bank transfer.
  • An invoice is issued each month.

Late Payment: If payment is not received within 7 days of the due date, Anomaly Arts reserves the right to suspend the website (take it offline) until payment is received. The website will be restored promptly upon receipt of the outstanding payment.

5. Intellectual Property

During the first 12 months

All intellectual property rights in the Website — including design, code, and structure — remain the exclusive property of Anomaly Arts for the duration of the initial 12-month contract period. The Client is granted a licence to use the Website for their business during this period.

After 12 months

Upon successful completion of the full initial 12-month contract (all 12 monthly payments received), ownership of the Website transfers to the Client. This includes the design, front-end code, and content created specifically for the Client's project.

Third-party assets (stock photos, fonts, plugins) remain subject to their respective licences.

Early termination

If the Client terminates the contract before completing the full 12-month period, the Website remains the property of Anomaly Arts. The Client will not receive the source files or retain the right to use the Website design.

6. Client Responsibilities

The Client agrees to:

  • Provide all content (text, images, logos) needed for the website in a timely manner.
  • Review and approve designs within a reasonable timeframe.
  • Ensure that all content provided is accurate and does not infringe on third-party rights.
  • Make payments on time as outlined in Section 4.

7. Delivery

Marketing websites are typically delivered within 7 working days from the date all required content is received from the Client. Delays caused by late content delivery or slow feedback from the Client are not the responsibility of Anomaly Arts.

8. Website Hosting and Uptime

Anomaly Arts provides reliable hosting with a target uptime of 99.9%. Scheduled maintenance windows are excluded from uptime calculations. We are not liable for downtime caused by circumstances beyond our control, including but not limited to server provider outages, natural disasters, or cyber attacks.

9. Termination

  • By the Client: The Client may terminate the contract by providing written notice to contact@anomaly-arts.com. Termination before the end of the 12-month period is subject to the intellectual property terms in Section 5.
  • By Anomaly Arts: We may terminate the contract if the Client fails to make payment within 30 days of the due date, or breaches any term of this agreement. In such cases, the website may be taken offline.

10. Limitation of Liability

Anomaly Arts shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Website. Our total liability under this agreement is limited to the total amount paid by the Client in the 12 months preceding the claim.

11. Modifications to Terms

Anomaly Arts reserves the right to update these Terms of Service. Clients will be notified of significant changes via email. Continued use of the service after changes have been communicated constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Malta. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Maltese courts.
